MindfulHand

The agreement between you and MindfulHand

Effective: April 29, 2026

By creating an account or using MindfulHand, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use MindfulHand. These Terms form a legal agreement between you and MindfulHand.

If you are using MindfulHand on behalf of someone else (for example, an organization), you represent that you have authority to bind that party to these Terms.

2. What MindfulHand Is

MindfulHand is a wellness and self-reflection app. Features include:

Journaling with optional AI prompts

Mood tracking and daily check-ins

Conversations with Ollie, an AI companion designed to listen and offer gentle support

Breathing and grounding exercises

A personal crisis plan and quick access to crisis hotlines

Coloring, games, and other low-pressure activities

3. Important Health Disclaimer

MindfulHand is not a medical service, therapy, counseling, or crisis-response service. Ollie is an AI companion, not a licensed professional. The content you receive from MindfulHand is for general support and self-reflection only and should not be used to diagnose, treat, cure, or prevent any medical or mental-health condition.

If you are experiencing a mental-health emergency, please contact one of the following immediately:

Always seek the advice of a qualified mental-health professional or physician for medical concerns.

4. Eligibility

You must be at least 13 years old to use MindfulHand. We verify this at signup by collecting your date of birth and blocking accounts for users under 13.

If you are between 13 and 17, you must provide a parent or legal guardian's email address when you sign up. Your account will not become active until your parent or guardian clicks the confirmation link we send to that address. By providing your parent or guardian's email, you confirm that you have their permission to do so.

If you sign in using Apple or Google, you may be asked to provide your date of birth shortly after sign-in if we don't already have it on file. Full app features may be limited until you provide a valid date of birth that meets our minimum age requirement.

MindfulHand is offered globally, but features and availability may vary by region. We may refuse service to users in jurisdictions where compliance is impractical.

5. Your Account

You are responsible for the security of your account, including keeping your password confidential. You agree to:

Provide accurate information when creating your account.

Notify us promptly if you suspect unauthorized access.

Not share your account credentials with anyone else.

Take responsibility for activity that occurs under your account.

You may delete your account at any time using the "Delete Account" button in the Profile screen. Deletion is permanent and removes all associated data.

6. Acceptable Use

To keep MindfulHand a safe space, you agree not to:

Use MindfulHand for any unlawful purpose or to violate the rights of others.

Attempt to disrupt, hack, or reverse-engineer the service or any associated systems.

Submit content that is illegal, threatening to others, or designed to harm someone.

Use automated tools (bots, scrapers) to access the service.

Attempt to extract or repurpose Ollie's responses for commercial purposes outside personal use.

Impersonate another person or misrepresent your identity to obtain access.

Violations may result in account suspension or permanent termination, with or without notice.

7. Your Content

Anything you create in MindfulHand — your journal entries, conversations with Ollie, mood notes, crisis plan items — remains yours. You retain full ownership.

By using MindfulHand, you grant us a limited, non-exclusive, royalty-free license to store, transmit, and display your content solely as needed to operate the service for you. We do not sell your content, share it with advertisers, or use it to train any AI model. This license ends immediately when you delete your account.

8. Our Content

MindfulHand, including the Ollie name and character, the brand and logo, and the design of the app, are owned by MindfulHand and our licensors. We grant you a limited, non-transferable license to use the MindfulHand app for personal, non-commercial use under these Terms. You may not copy, modify, redistribute, or commercially exploit MindfulHand's content without written permission.

9. Subscriptions and Billing

MindfulHand may offer optional paid subscriptions. If you subscribe:

Subscriptions are billed through your Apple ID via the App Store.

Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.

You can manage or cancel your subscription in the Settings app on your device, under your Apple ID.

Refunds are handled by Apple in accordance with Apple's refund policies; we do not process refunds directly.

Free features remain available regardless of subscription status. Crisis-related features (Crisis Plan, hotline links) are always free.

10. Privacy

Your privacy matters. Please review our Privacy Policy (available at mindfulhand.com/privacy) to understand what information we collect, how we use it, and your rights.

11. Service Changes and Availability

We may update, change, or discontinue features at any time. We may also update the underlying AI providers (Gemini, ElevenLabs, etc.) without notice if doing so improves the service or reduces cost. We are not liable for any temporary unavailability of MindfulHand or any changes that affect the service.

12. Termination

You may stop using MindfulHand and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if continuing to provide the service to you would create legal risk for us, or if we discontinue the service entirely. We will give you reasonable notice unless doing so would harm other users or the service.

13. Disclaimers

MindfulHand is provided "as is" and "as available". We make no warranties — express or implied — about the reliability, accuracy, or fitness of MindfulHand for any particular purpose. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

Ollie's responses are generated by AI and may be incorrect, incomplete, or contextually off. Do not rely on Ollie for advice that requires a licensed professional, including medical, legal, or financial guidance.

14. Limitation of Liability

To the maximum extent permitted by law, MindfulHand and its operators are not liable for indirect, incidental, special, or consequential damages arising from your use of the service, including loss of data, emotional distress, or any decisions made based on Ollie's responses or the content within the app.

In no event will our total liability to you exceed the greater of (a) the amount you paid us in the past twelve months, or (b) five hundred U.S. dollars ($500).

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. If those laws apply to you, some of these provisions may not apply.

15. Indemnification

You agree to defend, indemnify, and hold harmless MindfulHand, its operators, contractors, and licensors from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your use of MindfulHand in a way that violates applicable law, or any content you submit through the app.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Ohio, unless mandatory consumer-protection laws in your jurisdiction require otherwise.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes within the app or via email. Continued use of MindfulHand after the changes take effect constitutes acceptance of the updated Terms.
